Gen. Michael Flynn promoted that exact idea Tuesday evening when he tweeted a press release from an Ohio-based conservative political organization.<\/p>\n<div class=\"o-articleBody__embed --twitter element element-oembed\">\n<div class=\"twitter-tweet twitter-tweet-rendered\"><iframe id=\"twitter-widget-0\" class=\"\" title=\"Twitter Tweet\" src=\"https:\/\/platform.twitter.com\/embed\/index.html?dnt=false&amp;embedId=twitter-widget-0&amp;frame=false&amp;hideCard=false&amp;hideThread=false&amp;id=1333916403389370369&amp;lang=en&amp;origin=https%3A%2F%2Fwww.militarytimes.com%2Fnews%2Fyour-military%2F2020%2F12%2F02%2Fcalls-for-martial-law-and-us-military-oversight-of-new-presidential-elections-draws-criticism%2F&amp;theme=light&amp;widgetsVersion=ed20a2b%3A1601588405575&amp;width=550px\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-tweet-id=\"1333916403389370369\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">Calling former Vice President Joe Biden\u2019s Nov. 3 victory over Trump \u201cfraudulent,\u201d the Ohio-based \u201cWe The People Convention\u201d took out a full-page ad in the Washington Times on Tuesday urging Trump to \u201cimmediately declare a limited form of Martial Law, and temporarily suspend the Constitution and civilian control of these federal elections, for the sole purpose of having the military oversee a re-vote.\u201d<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">The organization called for the revote to include only registered voters with photo IDs, to be limited to only paper ballots, to be hand counted and with members of both Democrat and Republican parties observing.<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">\u201c<span style=\"font-size: 14pt;\"><strong>Unfortunately, we are at the point where we can only trust our military to do this because our corrupt political class and courts have proven their inability to act fairly and within the law,<\/strong><\/span>\u201d the group argued.<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">The White House did not respond to a request for comment about the call for martial law. But during a press briefing Wednesday afternoon, White House press secretary Kayleigh McEnany referred to Flynn as \u201ca valiant hero who served his country both on the battlefield and then in government\u201d but did not reference his calls for military action in response to the election results.<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\"><span style=\"font-size: 14pt;\"><strong>\u201cThe president has said that he believes all legal votes to be counted and all illegal votes should not be counted, and the campaign is pursuing that target=\"_blank\" rel=\"noopener noreferrer\">who pleaded guilty to lying to FBI investigators<\/a> about his interaction with Russian contacts during Trump\u2019s 2016 transition to the White House, was recently pardoned by Trump.<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">The former head of the Defense Intelligence Agency from 2012 to 2014, and later briefly serving as Trump\u2019s national security adviser, Flynn tweeted out We The People Convention\u2019s press release Tuesday to his more than 1 million followers, with the message \u201c<span style=\"font-size: 18pt;\"><strong>Freedom never kneels except for God.<\/strong><\/span>\u201d<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">The concept of the military being involved in such a revote, and that Flynn and other once-respected military officials, including retired Air Force three-star <a href=\"https:\/\/www.militarytimes.com\/news\/your-army\/2020\/12\/01\/this-retired-three-star-falsely-claims-us-soldiers-died-attacking-a-cia-facility-in-germany-tied-to-election-fraud\/\" target=\"_blank\" rel=\"noopener noreferrer\">Thomas McInerney<\/a>, would advocate martial law, raises alarms for constitutional scholars and military-civilian experts.<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">The idea is \u201cpreposterous,\u201d said Bill Banks, a Syracuse University professor with expertise in constitutional and national security law.<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">\u201cApart from the fact that state and now federal investigators have found no evidence of election fraud that would change the election outcome, martial law has no place in the United States absent a complete breakdown of civil governing mechanisms,\u201d he told Military Times.<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">Martial law, he added, \u201csimply has the military in charge, subject only to military orders, not civilian law.\u201d<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">It has not been invoked in the U.S. \u201csince the attack on Pearl Harbor, and there is no likelihood or justification for martial law now,\u201d said Banks. \u201c<span style=\"font-size: 14pt;\"><strong>Our civilian institutions have, in fact, revealed themselves to be resilient in responding to unprecedented partisan attacks on election administration and vote counting in state and local systems across the United States.<\/strong><\/span>\u201d<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">That retired military leaders would push such measures would violate their oath to the Constitution, said Risa Brooks, civil-military relations expert and Allis Chalmers Associate Professor of political science at Marquette University.<\/p>\n<p class=\"o-articleBody__text a-body1 element element-paragraph\">\u201cAs general officers, these men spent long careers committed to defending the Constitution,\u201d she told Military Times. \u201cCalling for martial law and a suspension of the Constitution is a direct violation of their oath to uphold it.\u201d<\/p>\n<div
