claims a US Supreme Court ruling means that people who have received mRNA-based COVID-19 vaccines are now patented and legally \u201cno longer human\u201d.<\/p>\n<p>The <a href=\"https:\/\/www.instagram.com\/p\/CRHxl3nt7lR\/\">July 10 post<\/a> from an Australia-themed account features a screenshot referring to a 2013 case, which the text says included a ruling that the human genome could be patented if modified by mRNA vaccines.<\/p>\n<p>\u201cThis means that everyone who has received the vaccine is now technically \u2018patented\u2019 and something that is patented is \u2018proprietary\u2019 and will be included in the definition of \u2018transhumans\u2019,\u201d the text in the screenshot says.<\/p>\n<p>Similar screenshots and claims have circulated widely on social media, for example in a video <a href=\"https:\/\/fb.watch\/6S7hjEaTpQ\/\">here<\/a>, as well as on various meme libraries, blogs and forums (see <a href=\"https:\/\/ifunny.co\/tags\/patented\">here<\/a>, <a href=\"https:\/\/www.blaqsbi.com\/3jsy-Post-The-Vaccinated-can-be-Patented-Owned\">here<\/a> and <a href=\"https:\/\/8kun.top\/qresearch\/res\/14069866.html\">here<\/a>).<\/p>\n<p>The claim in the post can be traced as far back as an <a href=\"https:\/\/web.archive.org\/web\/20210718184315\/https:\/\/thecovidblog.com\/2021\/04\/27\/supreme-court-pfizer-moderna-et-al-may-own-your-genes-once-youre-injected-with-their-lab-created-mrna-dna\/\">April 27 post <\/a>on The COVID Blog, which frequently posts misinformation on COVID-19 and vaccines.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www-media.aap.com.au\/wp-content\/uploads\/2021\/07\/21170002\/eca04d977420db5ee5bff89cdb3e323c7184b3196cd7ea5c9484833fd5be0ebf.jpg?v=1626850804\" alt=\"The Instagram post's screenshot\" \/><figcaption>\u00a0<em>The post includes claims that people vaccinated against COVID-19 are legally no longer human.<\/em>\u00a0<\/figcaption><\/figure>\n<h2>The Analysis<\/h2>\n<p>The post repeats a frequently debunked claim that mRNA COVID-19 vaccines alter the human genome alongside incorrect information about the US Supreme Court case and a legal interpretation dismissed as \u201cnonsensical\u201d by experts.<\/p>\n<p>The false claim that mRNA vaccines for COVID-19 modify either the human genome or DNA has been addressed multiple times by <strong>AAP FactCheck<\/strong> (see <a href=\"https:\/\/www.aap.com.au\/chill-out-cold-storage-mrna-covid-19-vaccines-are-legitimate\/\">here<\/a>, <a href=\"https:\/\/www.aap.com.au\/vaccine-being-developed-for-covid-19-wont-alter-a-persons-dna\/\">here<\/a> and <a href=\"https:\/\/www.aap.com.au\/covid-19-vaccine-gene-therapy-suggestion-diagnosed-as-false\/\">here<\/a>), as well as by other fact-checking organisations (see <a href=\"https:\/\/fullfact.org\/health\/mrna-covid-vaccine\/\">here<\/a>, <a href=\"https:\/\/apnews.com\/article\/archive-fact-checking-9340521654\">here<\/a>, <a href=\"https:\/\/www.reuters.com\/article\/uk-factcheck-covid-19-vaccine-modify\/false-claim-a-covid-19-vaccine-will-genetically-modify-humans-idUSKBN22U2BZ\">here<\/a> and <a href=\"https:\/\/theconversation.com\/can-the-pfizer-or-moderna-mrna-vaccines-affect-my-genetic-code-162590\">here<\/a>) and agencies such as the US <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/vaccines\/different-vaccines\/mrna.html\">Centers for Disease Control and Prevention (CDC)<\/a>.<\/p>\n<p>Both the Pfizer and Moderna vaccines use messenger <a href=\"https:\/\/www.genome.gov\/genetics-glossary\/messenger-rna\">RNA (mRNA)<\/a>, a molecule that puts DNA instructions into action, <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/vaccines\/different-vaccines\/mrna.html\">to cause the body\u2019s cells to make a protein piece<\/a> that in turn triggers an immune response and protects the recipient from the virus.<\/p>\n<p>The post attempts to link the vaccine technology to <a href=\"https:\/\/www.supremecourt.gov\/opinions\/12pdf\/12-398_1b7d.pdf\">a 2013 US Supreme Court case<\/a> involving the <a href=\"https:\/\/www.amp.org\/about\/who-we-are\/\">Association for Molecular Pathology<\/a> and <a href=\"https:\/\/myriad.com\/about-myriad\/inside-myriad\/overview\/\">Myriad Genetics<\/a>.<\/p>\n<p><a href=\"https:\/\/www.supremecourt.gov\/opinions\/12pdf\/12-398_1b7d.pdf\">According to the ruling<\/a>, <span style=\"font-size: 14pt;\"><strong>Myriad Genetics had discovered the location of two genes which significantly increased the risks of breast and ovarian cancer when they mutated and had patented a method for testing for these gene mutations<\/strong><\/span> (page 1).<\/p>\n<p><strong><span style=\"font-size: 14pt;\">The court decided Myriad Genetics was unable to patent the isolation of the two cancer-causing genes because they were naturally occurring<\/span><\/strong> (page 2).<\/p>\n<p>However, it said the creation of the synthetic cDNA \u2013 DNA synthesised from a strand of mRNA \u2013 involved in the testing process could be patented because it had been modified from its natural state (page 2-3).<\/p>\n<p>But the court did not find that the human genome could be patented if it was modified, as claimed in the post. In fact, the judgment explicitly stated that it did not deal with \u201cthe patentability of DNA in which the order of the naturally occurring nucleotides has been altered\u201d (page 21).<\/p>\n<p>The ruling also makes no mention of mRNA vaccines or vaccines in general.<\/p>\n<p><a href=\"https:\/\/faculty.utah.edu\/u0989706-JORGE_L_CONTRERAS\/hm\/index.hml\">University of Utah law professor and adjunct professor in human genetics <span style=\"font-size: 14pt;\"><strong>Jorge<\/strong><\/span> <strong><span style=\"font-size: 14pt;\">Contreras<\/span><\/strong><\/a><strong><span style=\"font-size: 14pt;\">,<\/span><\/strong> who has written a <a href=\"https:\/\/www.amazon.com\/Genome-Defense-Inside-Battle-Determine\/dp\/1616209682\/ref=sr_1_3?dchild=1&amp;keywords=contreras+genome+defense&amp;qid=1626094132&amp;sr=8-3\">book on the Myriad Genetics Supreme Court case<\/a>, told <strong>AAP FactCheck<\/strong> the claims in the Instagram post are \u201cpatently absurd\u201d.<\/p>\n<p><strong><span style=\"font-size: 18pt;\">Prof Contreras said the post was correct that the Supreme Court ruled human DNA could not be patented because it was a product of nature.<\/span> <\/strong>However, the same ruling did not determine that the human genome could be patented if it was modified, or that those who received a vaccine which modified their genome could be patented, he added.<\/p>\n<p>\u201cJust because a patented substance is injected into a person, that does not, under even the wildest interpretation of patent law, mean that the person somehow becomes \u2018patented\u2019,\u201d Prof Contreras said via email. \u201cAt the most basic level, <span style=\"font-size: 14pt;\"><strong>the US Patent Act expressly prohibits patenting human organisms.<\/strong><\/span>\u201d<\/p>\n<p>He referred to Section 33(a) of the <a href=\"https:\/\/www.congress.gov\/bill\/112th-congress\/house-bill\/1249\/text\">2011 Leahy-Smith America Invents Act<\/a>, which states, \u201cNotwithstanding any other provision of law, no patent may issue on a claim directed to or encompassing a human organism.\u201d<\/p>\n<p>Prof Contreras said: \u201cEven without this statute, the idea that injecting someone with a patented vaccine renders that person patented makes no sense. Does implanting a patented artificial heart valve into a person somehow make that person covered by the heart valve patent? Does taking a patented drug? Of course not.<\/p>\n<p>\u201cThe \u2018making\u2019 of further copies of the mRNA construct within the person\u2019s body is authorised as the natural and intended use of the patented item \u2026 The person, of course, would not be permitted to somehow extract the vaccine from his arm, then replicate it and begin to sell vaccine doses. But the idea that the person is patented is utter nonsense.\u201d<\/p>\n<p><a href=\"https:\/\/expert.gwu.edu\/display\/laracs\">George Washington University health policy associate professor Lara Cartwright-Smith<\/a>, who has <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC3982540\/\">written a paper<\/a> on the implications of the 2013 Supreme Court case, told <strong>AAP FactCheck<\/strong> the claims in the post were \u201cboth factually and legally incorrect\u201d.<\/p>\n<p>\u201cReceiving an mRNA vaccine does not and cannot alter one\u2019s DNA, so the basis for the claim is wrong,\u201d Dr Cartwright-Smith said via email.<\/p>\n<p>She also said a person cannot be legally patented. <span style=\"font-size: 14pt;\"><strong>While the Supreme Court ruling said cDNA (cmplimentary DNA) could be patented, this in no way affected the legal status of the person who underwent the relevant procedure, she added.<\/strong><\/span><\/p>\n<p>The Associated Press <a href=\"https:\/\/apnews.com\/article\/fact-checking-858056718583\">previously labelled similar claims<\/a> as false.<\/p>\n<h2>The Verdict<\/h2>\n<p><strong><span style=\"font-size: 14pt;\">mRNA-based COVID-19 vaccines do not alter the human genome \u2013 and even if they did, this would not mean the vaccinated were legally patented.<\/span><\/strong><\/p>\n<p>The Supreme Court case cited in the posts did not find that the human genome could be patented if it were altered. In fact, US law bans any patents that involves the human organism.
