in a U.S. court of law.<\/p>\n<p>The federal government has granted companies like <span id=\"RegularArticle-QuoteInBody-2\" class=\"QuoteInBody-quoteNameContainer\" data-test=\"QuoteInBody\"><a href=\"https:\/\/www.cnbc.com\/quotes\/PFE\/\">Pfizer<\/a><span id=\"-WatchlistDropdown\" class=\"AddToWatchlistButton-watchlistContainer\" data-analytics-id=\"-WatchlistDropdown\"><\/span><\/span><\/p>\n<p>and <span id=\"RegularArticle-QuoteInBody-3\" class=\"QuoteInBody-quoteNameContainer\" data-test=\"QuoteInBody\"><a href=\"https:\/\/www.cnbc.com\/quotes\/MRNA\/\">Moderna<\/a><span id=\"-WatchlistDropdown\" class=\"AddToWatchlistButton-watchlistContainer\" passed,\u201d said Rogge Dunn, a Dallas labor and employment attorney. \u201cPharmaceutical companies typically aren\u2019t offered much liability protection under the law.\u201c<\/p>\n<p>You also can\u2019t sue the Food and Drug Administration for authorizing a vaccine for emergency use, nor can you hold your employer accountable if they mandate inoculation as a condition of employment.<\/p>\n<p>Congress <a href=\"https:\/\/www.federalregister.gov\/documents\/2010\/10\/15\/2010-25110\/countermeasures-injury-compensation-program-cicp-administrative-implementation-interim-final-rule\" target=\"_blank\" rel=\"noopener\">created a fund<\/a> specifically to help cover lost wages and out-of-pocket medical expenses for people who have been irreparably harmed by a \u201ccovered countermeasure,\u201d such as a vaccine. But it is difficult to use and rarely pays. Attorneys say it has compensated less than 6% of the claims filed in the last decade.<\/p>\n<\/div>\n<h2 class=\"ArticleBody-subtitle\"><a id=\"headline0\"><\/a>Immune to lawsuits<\/h2>\n<div class=\"group\">\n<p>In February, Health and Human Services Secretary Alex Azar <a href=\"http:\/\/govinfo.gov\/content\/pkg\/FR-2020-03-17\/pdf\/2020-05484.pdf\" target=\"_blank\" rel=\"noopener\">invoked the Public Readiness and Emergency Preparedness Act<\/a>. The 2005 law empowers the HHS secretary to provide legal protection to companies making or distributing critical medical supplies, such as vaccines and treatments, unless there\u2019s \u201cwillful misconduct\u201d by the company<strong>. <\/strong>The protection lasts until 2024.<\/p>\n<p>That means that for the next four years, these companies <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/LSB\/LSB10443\" target=\"_blank\" rel=\"noopener\">\u201ccannot be sued for money damages in court\u201d<\/a> over injuries related to the administration or use of products to treat or protect against <a href=\"https:\/\/www.cnbc.com\/coronavirus\/\">Covid<\/a>.<\/p>\n<p>HHS declined CNBC\u2019s request for an interview.<\/p>\n<p>Dunn thinks a big reason for the unprecedented protection has to do with the expedited timeline.<\/p>\n<p>\u201cWhen the government said, \u2018We want you to develop this four or five times faster than you normally do,\u2019 most likely the manufacturers said to the government, \u2018We want you, the government, to protect us from multimillion-dollar lawsuits,\u2019\u201d said Dunn.<\/p>\n<\/div>\n<blockquote data-test=\"Pullquote\">\n<div class=\"Pullquote-pullquoteFadedIn Pullquote-pullquote\">\n<div>\n<div class=\"Pullquote-quote\">It is very rare for a blanket immunity law to be passed. &#8230; Pharmaceutical companies typically aren\u2019t offered much liability protection under the law.<\/div>\n<div class=\"Pullquote-sourceWrapper\">\n<div class=\"Pullquote-source\">Rogge Dunn<\/div>\n<div class=\"Pullquote-info\">Dallas labor and employment attorney<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>You can\u2019t sue Pfizer or Moderna if you have severe Covid vaccine side effects.
